Terms & Conditions

These terms and conditions apply to all orders placed through gifterie.shop ("Gifterie", "we", "us"). By placing an order, you confirm that you have read, understood and agree to these terms in full.

1. General

• Gifterie is a sole trader registered in the Netherlands.
• All prices are shown in Euros (EUR) and include VAT where applicable.
• We reserve the right to update or amend these terms at any time without prior notice. The version in force at the time of your order applies.
• If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force.

2. Orders & contract

• Placing an order constitutes an offer to purchase. A binding contract is only formed once we send you an order confirmation by email.
• We reserve the right to refuse or cancel any order at our sole discretion, including in cases of pricing errors, suspected fraud or stock unavailability. In such cases we will issue a full refund.
• You are responsible for ensuring all order details — including personalisation, delivery address and contact information — are correct before submitting. We cannot be held responsible for errors resulting from incorrect information provided by you.

3. Personalised products

• Personalised products are made to order and are exempt from the standard right of withdrawal under Article 16(c) of the EU Consumer Rights Directive (2011/83/EU), as they are clearly personalised goods.
• You are solely responsible for the accuracy, spelling, grammar and content of any personalisation you submit. We will produce exactly what you enter.
• We reserve the right to refuse personalisation requests that contain offensive, illegal or infringing content.
• Once a personalised order has entered production, it cannot be changed or cancelled.

4. Prices & payment

• All prices are subject to change without notice. The price shown at the time of your order is the price you pay.
• Payment is due in full at the time of ordering. We accept major credit and debit cards and other payment methods shown at checkout.
• We are not responsible for any charges applied by your bank or payment provider.

5. Delivery

• Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, adverse weather, or other circumstances outside our control.
• Risk of loss and title for products pass to you upon delivery to the address you provided.
• If a parcel is returned to us due to an incorrect address or failed delivery attempts, re-delivery costs are your responsibility.
• We are not liable for parcels lost or delayed due to incorrect delivery information provided by you.

6. Limitation of liability

• To the maximum extent permitted by applicable law, Gifterie's total liability to you in connection with any order shall not exceed the total amount paid by you for that order.
• We are not liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profit, loss of data, loss of goodwill, or any other intangible losses, even if we have been advised of the possibility of such damages.
• We are not liable for any damage, loss or expense arising from: circumstances beyond our reasonable control; your failure to follow product instructions or care guidelines; misuse, accident or unauthorised modification of a product; or third-party actions including delivery carriers.
• Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under Dutch or EU law.

7. Warranty disclaimer

• Products are provided as described on our website. We make no additional warranties, express or implied, beyond those required by law.
• Product images are for illustrative purposes only. Colours and appearance may vary slightly due to screen settings and manufacturing tolerances.

8. Intellectual property

• All content on this website — including but not limited to text, images, logos, designs and product descriptions — is the property of Gifterie and protected by applicable intellectual property laws.
• You may not copy, reproduce, distribute or use any content from this website without our prior written permission.
• By submitting personalisation content (text, images or other material), you confirm that you own or have the right to use that content, and you grant us a non-exclusive licence to use it solely to fulfil your order. You are solely liable for any third-party claims arising from personalisation content you submit.

9. Right of withdrawal (non-personalised products)

• For non-personalised products, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving a reason, in accordance with Dutch and EU consumer law.
• To exercise this right, you must notify us within 14 days of receipt. Return shipping costs are at your expense unless the product is faulty or incorrect.
• Refunds for returned non-personalised items will be processed within 14 days of us receiving the returned goods in original, unused condition.

10. Governing law & disputes

• These terms are governed by the laws of the Netherlands.
• Any disputes arising from these terms or your use of our website shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.
• We are not obliged to participate in alternative dispute resolution schemes, but we will always try to resolve complaints fairly and promptly. Please contact us first.
